Carolina Theatre Star Membership Program Rules and Regulations

These terms and conditions (this "Agreement") govern The Carolina Theatre Star Membership Program. The Carolina Theatre Star Membership Program is a loyalty program brought to you The Carolina Theatre of Durham, Inc. (collectively "we," "us," "our," "ours"). Purchase or use of any membership in The Carolina Theatre Star Membership Program ("Membership") at any time subjects the purchaser or user ("you," "your," "yours," "Member") to the provisions of this Agreement.

1. BENEFITS
The Carolina Theatre Star Membership Program entitles Members to the benefits according to their level of membership. Membership must be paid in full before you are eligible to receive any benefits. There is no guarantee that you will see or meet celebrities at any membership level.

2. CERTAIN CONDITIONS
(a) For any Member's discount or other benefit to apply, the Membership account must be active and available at the time of purchase. Members will NOT be reimbursed retroactively for purchases made without an active, verifiable membership at the time of purchase.

(b) Member's everyday discount cannot be used in conjunction with other discount programs.

(c) Memberships are non-transferable. Only the card holder (whose name is on the card) is eligible to receive Star Membership benefits. At memberships $150 and up, you may add one additional adult in your household to your membership card.

(d) We expect Members to submit and maintain accurate and current user information in connection with their Memberships. Such information includes name, address, email address, and telephone number. Members can change their account information by completing a new membership form and mailing it to The Carolina Theatre. They may also call the Development Department (919/560-3040 ext. 226) to update their information. We cannot assume any liability for correspondence, either mail or email, that is lost, delayed, or misdirected.

3. MEMBERSHIP FEE
We may change the Membership fees at any time, but changes will apply only to new and renewal Memberships. The fee is not refundable.

4. TERMS OF MEMBERSHIPS
The initial term of a Membership shall commence on the date it is purchased and continue until one year from the last day of the calendar month before the Membership was purchased.

5. DISCLAIMERS; LIMITATION OF LIABILITY
Use of the Carolina Theatre Star Membership Program and any of its associated benefits is at your sole risk. The membership benefits are provided on as ‘as is’ and ‘as available’ basis.

The Carolina Theatre of Durham, Inc. and all of it’s respective affiliates, directors, officers and agents (collectively Membership Providers) expressly disclaim all warranties of any kind, whether express or implied, including, bit not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Membership Providers make no warranty that (i) The Carolina Theater Star Membership Program will meet your requirements, (ii) The Carolina Theatre Star Membership Program will be uninterrupted, timely, secure, or error-free, or (iii) The quality of any products, services, information, or other material purchased or obtained by you from your use of The Carolina Theatre Star Membership Program will meet your expectations.

Membership Providers shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, date or other intangible losses (even if Membership Provider has been advised of the possibility of such damages), resulting from: (i) The use or the inability to use The Carolina Theatre Star Membership Program or any benefits thereof; (ii) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered via the use of The Carolina Theatre Star Membership Program; (iii) Unauthorized access to or alteration of your Carolina Theatre Star Membership Program data; or (iv) any other matter relating to The Carolina Theatre Star Membership Program.

6. ACKNOWLEDGMENT
This Agreement, including all documents referenced herein, represents the entire understanding between us and any user of The Carolina Theatre Star Membership Program with respect to The Carolina Theatre Star Membership Program and supersedes any other agreements, statements or representations. Headings used in this Agreement are for reference only and shall not affect the meaning of any terms. Any user of any portion of The Carolina Theatre Star Membership Program is deemed to have accepted the terms and conditions of this Agreement.

7. CHANGES TO THIS AGREEMENT
We may change the terms of this Agreement at any time by posting a revised Agreement on the Member Program website located at www.carolinatheatre.org/theatreinfo/membership. We may also notify Members of such change in writing either by regular mail or via email to the email address in the Member's account. Any change shall take effect immediately, unless otherwise provided. You may view the current version of this Agreement at any time online at www.carolinatheatre.org/theatreinfo/membership or you may obtain a copy of it by calling 919/560-3040 ext. 226. Courtesy copies are also available at The Carolina Theatre; but because of printing and distribution delays, always check the Member Program website (at www.carolinatheatre.org/theatreinfo/membership) for the most up-to-date version.
